ICJ grants Parties to the Nauru Agreement participation in Climate Change advisory proceedings

The International Court of Justice (ICJ) has granted authorisation to the Parties to the Nauru Agreement Office (PNAO) to participate in advisory proceedings concerning the Obligations of States in respect of Climate Change. 

“The PNAO was established under the 1982 Nauru Agreement concerning Cooperation in the Management of Fisheries of Common Stocks,” stated the ICJ in a statement. 

According to Article 66 of its Statute, the Court determined that the PNAO is likely to provide valuable information on the questions submitted to it by the General Assembly. 

As a result, the PNAO is permitted to submit a written statement on those questions and offer written comments on any statements made by States or other organisations. 

The deadlines for these submissions are 22 March 2024, and 24 June 2024, respectively, as extended by President Joan Donoghue’s Order of 15 December 2023. 

The subsequent procedure remains subject to further decision by the Court.
